SC Rules In Favour Of DigiPe In Trademark Dispute With PhonePe

The Madras High Court had previously mentioned that the only similarity between the two parties was the suffix 'Pe'.

The Supreme Court dismissed PhonePe's appeal against DigiPe Fintech for using the 'DigiPe' trademark.

The Court refused to stop DigiPe from using the trademark until the main case is decided. It stated that many other companies, such as BharatPe, use 'Pe' as a suffix in their names.

The original lawsuit between PhonePe and DigiPe is ready for trial. The Madras High Court had previously mentioned that the only similarity between the two parties was the suffix 'Pe'. It also noted that PhonePe did not provide enough evidence to show that customers would be confused by the use of 'Pe' by DigiPe.

Moreover, PhonePe and DigiPe operated in different areas. PhonePe offers various payment instruments to businesses and individuals, while DigiPe only serves merchant establishments. The High Court also questioned PhonePe's consistency in similar cases in other high courts, raising doubts about PhonePe's claims.
